Please read these Terms of Service ("Terms") carefully before using the Nurses.ai mobile application ("App") operated by Nurses.ai ("we," "our," or "us"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
1. Eligibility
Nurses.ai is designed exclusively for nursing professionals and nursing students. By creating an account, you represent that you are:
- At least 18 years of age
- A licensed nurse (RN, LPN/LVN, NP, APRN, CNA, CRNA, CNM, or equivalent) or an actively enrolled nursing student
- Capable of forming a binding legal agreement
We reserve the right to verify your professional credentials at any time. Failure to verify credentials upon request may result in account suspension or termination.
2. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to:
- Provide accurate and complete registration information
- Promptly update your information if it changes
- Notify us immediately of any unauthorized access to your account
- Not share your account with any other person
- Not create multiple accounts
🏥 3. HIPAA Compliance & Patient Privacy
STRICT PROHIBITION: You agree to NEVER share Protected Health Information (PHI) as defined under the Health Insurance Portability and Accountability Act (HIPAA) anywhere on this platform, including feed posts, comments, direct messages, marketplace listings, AI chat conversations, and profile information.
What Constitutes PHI
PHI includes any individually identifiable health information relating to a patient's past, present, or future physical or mental health condition, the provision of healthcare to a patient, or payment for healthcare. This includes:
- Patient names, initials, or aliases
- All dates (birth, admission, discharge, death) except year
- Addresses and geographic data smaller than a state
- Phone numbers, fax numbers, and email addresses
- Social Security numbers
- Medical record numbers and health plan numbers
- Account numbers, certificate/license numbers
- Vehicle and device identifiers and serial numbers
- Web URLs, IP addresses
- Biometric identifiers (fingerprints, voiceprints)
- Full-face photographs and comparable images
- Any other unique identifying number, characteristic, or code
Consequences of PHI Violations
Sharing PHI on this platform is a serious violation of these Terms and federal law. Violations may result in:
- Immediate content removal
- Account suspension or permanent ban
- Reporting to relevant regulatory authorities
- Potential civil penalties of $100 to $50,000 per violation (up to $1.5 million per year)
- Potential criminal penalties up to $250,000 and imprisonment up to 10 years for willful violations
Safe Discussion Guidelines
When discussing clinical scenarios for educational purposes, you MUST fully de-identify all information using the HIPAA Safe Harbor method by removing all 18 categories of identifiers. Use generic descriptors such as "a middle-aged patient" or "a patient in a similar situation" rather than specific details.
🤖 4. AI Nursing Assistant
Educational Purpose Only
The AI nursing assistant ("Ask AI") is provided for educational and informational purposes only. It is NOT a substitute for professional medical judgment, clinical decision-making, or direct patient care.
AI Limitations
The AI assistant may occasionally provide inaccurate, incomplete, or outdated information. You are solely responsible for verifying any information obtained through the AI assistant before applying it in a clinical setting. We are not liable for any clinical decisions made based on AI responses.
AI Usage Restrictions
You agree not to:
- Submit any PHI or patient-identifying information to the AI
- Use the AI for emergency medical situations (call 911 instead)
- Rely on the AI as the sole basis for clinical decisions
- Attempt to use the AI for purposes outside of nursing education and professional development
- Attempt to bypass the AI's content restrictions or safety filters
Free & Premium Access
Free users receive 5 lifetime AI messages. Premium subscribers (Nurses.ai Pro) receive unlimited AI access. Message limits are non-transferable and non-refundable.
5. User Conduct & Community Guidelines
You agree to use Nurses.ai in a professional, respectful, and lawful manner consistent with nursing professional standards and ethics.
Acceptable Behavior
- Treat all community members with respect and professionalism
- Share accurate information and cite sources when appropriate
- Report content that violates these Terms or community guidelines
- Respect intellectual property rights of others
- Use the marketplace honestly and fairly
Prohibited Behavior
- Posting harassing, discriminatory, threatening, or abusive content
- Sharing false or misleading medical/nursing information
- Impersonating another person or misrepresenting your credentials
- Spamming, soliciting, or posting unauthorized commercial content
- Sharing PHI or any patient-identifying information
- Uploading malicious software or interfering with app functionality
- Creating multiple accounts or evading blocks/bans
- Using the platform for illegal activities
- Scraping, harvesting, or collecting user data without consent
6. Content Ownership & License
Your Content
You retain all ownership rights to content you create and post on Nurses.ai. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content within the platform for the purpose of operating and promoting the service.
Content Removal
We reserve the right to remove any content that violates these Terms, community guidelines, or applicable law without prior notice. You may delete your own content at any time through the App.
Copyright Complaints
If you believe your copyrighted work has been infringed, please contact us at support@ainurse.io with a detailed description of the alleged infringement.
7. Marketplace
The Nurses.ai Marketplace allows users to buy and sell nursing-related items. By using the Marketplace, you agree to:
- Accurately describe items and their condition
- Communicate honestly with buyers and sellers
- Comply with all applicable laws regarding the sale of goods
- Not list prohibited items including prescription medications, controlled substances, stolen goods, counterfeit items, or items that violate any law
Disclaimer: Nurses.ai facilitates connections between buyers and sellers but is NOT a party to any transaction. We do not guarantee the quality, safety, or legality of items listed. All transactions are conducted at your own risk.
8. Subscriptions & Payments
Nurses.ai Pro Plans
- Monthly: $9.99/month
- Weekly: $3.99/week
Both plans include unlimited AI messages, ad-free experience, and priority support.
Billing
Subscriptions are billed through your Apple ID account. Payment is charged at confirmation of purchase. Subscriptions auto-renew unless canceled at least 24 hours before the end of the current billing period.
Cancellation & Refunds
You may cancel your subscription at any time through your Apple ID account settings (Settings > Your Name > Subscriptions). Cancellation takes effect at the end of the current billing period. Refund requests are handled by Apple in accordance with their refund policies.
Price Changes
We may change subscription pricing at any time. Price changes will not affect your current billing period and you will be notified before any price increase takes effect.
9. Blocking & Reporting
User Blocking
You may block any user at any time. Blocking a user will:
- Hide their posts from your feed
- Prevent them from sending you messages
- Automatically unfollow them
- Hide your content from their view
Blocked users are not notified. You can unblock users at any time.
Reporting
You are encouraged to report any content or behavior that violates these Terms. Reports are reviewed by our team and appropriate action will be taken, which may include content removal, warnings, or account suspension/termination.
10. Disclaimers & Limitation of Liability
NO MEDICAL ADVICE: NURSES.AI IS A PROFESSIONAL NETWORKING AND EDUCATIONAL PLATFORM. NOTHING ON THIS PLATFORM CONSTITUTES MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. Always seek the advice of qualified healthcare professionals for clinical questions. Never disregard professional medical advice or delay seeking it because of information obtained through this App.
"As Is" Service
The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by law, Nurses.ai and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of revenue, or clinical decisions made based on information obtained through the App.
Indemnification
You agree to indemnify and hold harmless Nurses.ai from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights, including HIPAA.
11. Termination
Our Rights
We may suspend or terminate your account at any time, with or without notice, for violations of these Terms, illegal activity, HIPAA violations, professional misconduct, or any reason we deem necessary to protect our community. Upon termination, your right to use the App ceases immediately.
Your Rights
You may delete your account at any time by contacting support@ainurse.io. Upon deletion, your personal data will be removed within 30 days, though de-identified aggregate data may be retained.
12. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Nurses.ai operates, without regard to conflict of law principles.
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules. You agree to waive your right to a jury trial and to participate in class action lawsuits.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or via email. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms. If you do not agree, you must stop using the App and delete your account.
